Successful withdrawal of domestic violence charges by Hornsby Police after negotiations by our Principal Lawyer

After an argument with her husband and a subsequent report to police, our 36 year old client who is a mother to two young children, was charged with three domestic violence offences by the Hornsby Police.

Immediately, our client entered Pleas of Not Guilty to the offences in Hornsby Local Court and the matter was adjourned for a Hearing date.

In the interim, the police served the evidence they intended to rely upon to our office. After reviewing the evidence, which related to two alleged violent incidents, it became apparent that our client had made partial admissions to engaging in the incidents. Despite this, Ms Regan gave advice to our client that we would have a strong position to negotiate the withdrawal of some of the charges based on weaknesses that were still apparent in the police case.

Ms Regan approached police and leveraged our client's position. We pointed out aspects of the case that the police would not be able to prove on the current charges our client was facing. Successfully, the police were convinced to withdraw two charges. The facts were also heavily redacted and amended to refer to only one incident on a far less serious scale than the original allegations by her husband.

As a result, our client was sentenced to a lenient penalty by the local court magistrate than what she was originally facing.

This was the most favourable outcome for our client, as a mother who has never been charged by police or brought before the court ever before.
